Mother-of-four, 40, is caught driving without a licence for the EIGHTEENTH time but still won't be jailed - despite having ice on her when she was arrested

A mother-of-four has evaded a jail sentence for the eighteenth time, despite being caught driving without a licence and stashing illegal substances in her car.

Police discovered drug paraphernalia and almost 3g of methamphetamine in Kylie Maree Herberts' car after she was pulled over in Kuluin, on the Sunshine Coast.

The repeat offender, who has been caught driving disqualified 10 times and driving unlicensed seven times, was reprimanded by Magistrate Mark Nolan for her 'absolute disregard' for licencing laws.

According to cops, the 40-year-old admitted to having bought the drugs, which is commonly known as ice, just a few hours before, and claimed she got behind the wheel to give someone a lift to a local address.

Herberts pleaded guilty in Maroochydore Magistrates Court to unlicensed driving, drug, utensil and property possession, according to Sunshine Coast Daily

In her defense, Herbert's Legal Aid lawyer, Michael Robinson claimed she wasn't in a position to purchase a drivers licence because of her low financial situation.   

However, Magistrate Mark Nolan questioned how Herbert's could afford to get her hands on drugs if she wasn't able to buy a licence. 

Herberts was sentenced to three months in prison, immediately suspended for 12 months. 

At the time of sentencing, Mr Nolan told Herberts she needed to set a better example to her four children and warned if she offended again she'd face time in jail.
