The State government and the Bangalore Development Authority (BDA) on Wednesday told the Karnataka High Court that they have not challenged the March 13, 2017 order of the National Green Tribunal directing the BDA not to proceed with the steel flyover project without securing the necessary environment clearance.
The BDA also told the court that it is yet to apply to the State Environment Impact Assessment Authority for environmental clearance.
A division bench comprising Chief Justice Dinesh Maheshwari and Justice Aravind Kumar recorded these submissions and adjourned till June the hearing on a PIL petition, filed in October 2016 by Namma Bengaluru Foundation against the then proposal of the State and the BDA to construct a six-lane elevated road from Basaveshwara Circle to Hebbal flyover via Mehkri underpass.
The High Court on October 7, 2017 had declined to stay the steel flyover project, but had said that it would be subject to the final order of the court.
Later, Citizen Action Forum had moved the NGT against the project. In March 2017, the tribunal had directed the BDA not to proceed with the project sans necessary environmental clearances and the tribunal’s order was made known to the High Court.
