Tribunal orders Rs 10 lakh relief for man disabled in accident

CHANDIGARH: The motor accident claim tribunal directed secretary of transport department of Haryana, general manager of Haryana Roadways, ICICI Lombard General Insurance Co. Ltd and driver of offending bus to jointly pay compensation of more than Rs 10 lakh to a person who suffered permanent disability after meeting with a road accident. He claimed compensation of Rs 15 lakh under provisions of Section 166 of the Motor Vehicles Act, 1988.


It was stated in the application that Joginder, 25, worked as an autorickshaw driver and had been earning Rs 3,300 per month. The matter dates back to May 24, 2009 when at about 4pm, the Joginder while driving his autorickshaw at a slow speed and on left side of the road, was going from Fandpuri to Saharanpur. There were other occupants in the vehicle too. When they reached the railway bridge, Ambala Road, a Haryana Roadways bus driven by Roop Chand at a fast speed in a rash and negligent manner, came from the opposite direction and struck against the autorickshaw. As a result of the collision, the claimant and other occupants received serious injuries. They were then rushed to a government hospital, from where the claimant was referred to PGI, Chandigarh.


The disability of the claimant was assessed to the extent of 43%. Thereafter, he was re-assessed for his disability in 2018 and the permanent disability assessed was to the extent of 50%. It was also mentioned that he is likely to face difficulty in driving vehicles. It was also mentioned that since the claimant would face hardships in going ahead with his profession, the tribunal awarded him compensation of Rs 10,04,452.
