BMW hit-and-run case: Vismay Shah's foreign honeymoon grounded

AHMEDABAD: The Gujarat high court on Monday grounded dreams of enjoying honeymoon at a foreign location by the BMW hit-and-run incident convict, Vismay Shah. The court rejected his request for renewal of passport to go abroad after marriage saying he could go to many interesting locations in India.
Shah got married on December 13 and was planning for a honeymoon abroad. For this, his advocates requested the court for permission for renewal of his passport, which is lying in custody of the trial court for nearly five years. The lawyer did specify the destination planned for the honeymoon.
Justice Sonia Gokani said that there are many interesting tourist destinations in India. In lighter tone, the court said that Shah could visit these places and enjoy, and there is no need to go out of the country for honeymoon.
Interestingly, while Justice Gokani ordered for renewal of Shah's passport, it would not be made available to him at this stage. The court ordered that Shah's passport should be sent for the renewal process and be deposited back with the trial court. The court said it may take further decision in future on whether to hand over the passport to Shah.
Hostile witnesses
Vismay Shah was convicted in 2015 by a sessions court to five-year imprisonment after his speeding car killed two friends, Shivam and Rahul, in the accident that occurred in Vastrapur on February 24, 2013. He had to obtain bail from the Supreme Court after his conviction. The courts in Gujarat have been strict on granting any relief to him, as the trial court as well as the high court had denied him bail during pre-conviction as well as post-conviction stages.
Following a controversial trial, which saw eye witnesses turning hostile, Shah got convicted. He has, however, struck a compromise with families of two boys who were killed in the accident – Shivam Dave and Rahul Patel.
