AMBALA: The district legal services authority (DLSA) has given compensation of Rs 1 lakh each to three family members and Rs 50,000 to the son of deceased Ram Gopal who had died in a road accident on January 7 in 2017. The police had presented the status of the case as an untraceable one, and the family had applied for the compensation under the Haryana Victim Compensation Scheme (HVCS), 2013 to the DLSA.
On January 8, 2017, on the complaint of Santosh, a case was registered at Sadar Ambala police station under section 279 and 304-A of the Indian Penal Code after Ram Gopal died in a road accident in Ambala.
The widow of Ram Gopal had filed an application to the DLSA under section 357-A of the Code of Criminal Procedure (CrPC) for compensation as she had no other source of income apart from her husband and she was struggling to survive with her three children Geeta, Anju, and Bharat Bhushan.
The DLSA looked into the matter and a report from in-charge of Sadar Ambala police station was sought, and the police had filed an untraced report which was accepted by the authority.
The surviving family appeared before the court and stated that only Bharat is earning Rs 60,000 per annum and the other members were surviving on his head.
Danish Gupta, chief judicial magistrate-cum-secretary of DLSA informed, “The case was reported to police within 48 hours of the occurrence of the accident and the family income is also less than Rs 4.5 lakh per annum. Therefore, the case is found fit for compensation under the HVCS, 2013. The victims have received Rs 1.2 lakh from the government and in the interest of justice, an amount of Rs 1 lakh each to Santosh, Geeta, and Anju has been awarded as compensation for rehabilitation. As Bharat is earning Rs 60,000 per annum an amount of Rs 50,000 is also awarded as compensation to him.”
