SC allows IT department to re-open tax assessment of the Gandhis

NEW DELHI: The Supreme Court on Tuesday allowed the Income Tax department to proceed against Congress leaders Sonia Gandhi and Rahul Gandhi with re-opening of their tax assessment for 2011-12 in connection with the National Herald case. However, it restrained the department from implementing it during the pendency of their plea in the apex court.

The top court said that it is not expressing any opinion on merit of the petitions filed by Congress president Rahul Gandhi and his mother Sonia Gandhi.

The top court's suggestion was accepted by the Gandhis, however, the IT department opposed it.

Solicitor general Tushar Mehta, appearing for the IT department, said that it should not be restrained from implementing the assessment order after it is passed against Gandhis. He said the court should hear the matter and pass appropriate orders.


However, the court said that its interim order is equitable to both sides.


The tax matter is related to the National Herald case in which the Congress leaders are also facing criminal proceedings.


A bench headed by Justice A K Sikri posted the matter for further hearing on January 8 next year.


The Gandhis and senior Congress leader Oscar Fernandes have challenged the Delhi High Court's September 10 verdict by which their plea against the re-opening of their tax assessments for 2011-12 was dismissed.
