HC rejects plea of MLA Basavaraja

The Karnataka High Court on Monday rejected a plea of K.R. Puram constituency MLA, B.A. Basavaraja, who had filed an application seeking dismissal of an election petition in which a defeated candidate had questioned his election to the Assembly in the polls held in May this year. Justice Ravi Malimath dismissed Mr. Basavaraja’s plea while holding that the issues raised in the petition, filed by D.A. Gopala of the JD(S), requires a trial to decide the allegations levelled against Mr. Basavaraja. The petitioner had sought a direction from the court to set aside Mr. Basavaraja’s election for non-disclosure of certain assets, and a criminal case. In his application, Mr. Basavaraja said certain information was inadvertently left out and denied the allegation that non-disclosure was intentional, while contending that the election cannot be set aside for this reason.
