The Delhi police's economic offences wing (EOW) have arrested three directors of a builders firm, 3C allegedly accused of diverting funds worth Rs 191 crores of the homebuyers into other companies and not delivering the houses on time. The accused were produced before the court and they were remanded on three days police custody.
According to the police, the accused have been identified as the Surpreet Singh Suri, Vidur Bhardwaj and Nirmal Singh, directors of Hacienda Projects Pvt Ltd. They were arrested for cheating, criminal conspiracy and criminal breach of trust. Police said that they were arrested from their residents in Panchsheel Vihar, Sainik Farms and Greater Kailash areas, respectively.
"We had received a complaint from a homebuyer who didn't get his flat in the Lotus 300 project in Noida sector 107. He said that six towers, which have been erected, are yet to be completed," said additional commissioner of police (EOQ), Suvashish Choudhary.
The complainant alleged that the project, launched in 2010, was to be delivered within 39 months from the date of allotment letter.
"Initially the company had displayed that the project shall only have 300 apartments. However, with mala fide intentions, he got his plan changed from the Noida Authority and increased the number of flats to 336, which is a violation of the terms of the Uttar Pradesh Apartment (Promotion of Construction, Ownership, and Maintenance Act 2010)," said Choudhary.
Police said that we had received more than 50 complaints from the investors who had invested around Rs 100 crore in the project. "There were a total 328 investors and the company has received around Rs 636 crores from them. Out of this, the company allegedly diverted Rs 191 crores into their subsidiary companies," said Choudhary.
Police have arrested the three under sections 120b (criminal conspiracy), 409 (criminal breach of trust) and 420 (cheating) of the Indian Penal code (IPC).
