NHRC summons DCP in Kamlesh Shah attack case
Anjaya Anparthi | tnn | Nov 27, 2018, 05:49 ISTNagpur: The National Human Rights Commission (NHRC) has summoned DCP zone-III Rahul Maknikar for not submitting a report within prescribed time period in the attack on RTI activist Kamlesh Shah.
Advocate Ankita, daughter of Shah, has filed a complaint with NHRC alleging that police did not register appropriate sections in the case, and also failed to identify the persons who attacked Shah.
NHRC, New Delhi, said, “A copy of the complaint dated September 13 received from Ankita was directed to be forwarded to the concerned authority calling for a report in the matter within four weeks. The complaint was transmitted to the commissioner of police (CP) on October 4. DCP of crime branch has asked DCP zone-III to submit the report through a communication dated October 16.
It was mentioned that in case the report is not received within the stipulated time, the Commission shall be constrained to invoke coercive process under section 13 of the Protection of Human Rights Act 1993, for personal appearance of the concerned authority. The report is still awaited.
The Commission takes serious view of the matter and exercising its power give under section 13(a) of the Protection of Human Rights Act 1993, directs to issue summons to DCP sub division no-3 (zone-III) for production of the requisite report. He is directed to appear in person before the Commission on January 7, 2019, at 11am. Should, however, the required information/documents be received on or before December 28, his personal appearance shall stand dispensed with,” the NHRC said.
Shah had lodged a complaint with Lakadganj police station on August 20 alleging he was attacked twice by some unidentified persons.
Ankita, in the complaint filed with NHRC, has also sought police protection to Shah citing incidents of attack on the latter two times within two years as he exposed various cases under RTI Act.
