Man gets 10-year-RI for sexual assault

CHANDIGARH: The UT district court has awarded imprisonment of 10 years to a man in a case of aggravated penetrative sexual assault of a minor. However, the accused was acquitted from the charges of rape.

The convict, Monu, has been sentenced under Section 6 (punishment for aggravated penetrative sexual assault) of Pocso Act and acquitted under Sections 363 (punishment for kidnapping), 376 (punishment for rape), 366 (kidnapping, abducting or inducing woman to compel her marriage, etc.) and 506 (punishment for criminal intimidation) of the Indian Penal Code.

On October 15, 2014, a compliant was filed by the mother of the minor, who is stated to be around 15 years old. According to the compliant, the minor left home without any intimation at 8pm on October 11, 2014. The family later came to know that she had gone with Monu, who is a resident of Shamli. When the family finally traced the minor victim and brought her home, the minor was allegedly in a state of shock.


The complainant stated that the minor had been lured on the pretext of marriage. According to the mother, the accused had come to their house when no one was around and raped the girl forcibly after which he told her that he would marry her. He also threatened her saying that he would kill her parents if she told anyone.


Next day, the minor ran away from her house to get married. Following the complaint, the police booked him under Sections 363, 366, 376, 506 IPC and Sec 4 of Pocso Act.


The defense counsel advocate Harish Chabbra argued that the accused was falsely implicated.
