Social worker moves HC for staying Hunkar Sabha by RSS

Nagpur: Social worker Janardhan Moon has moved the Nagpur bench of Bombay high court alleging that Rashtriya Swayamsevak Sangh (RSS) is conducting ‘Hunkar Sabha’ on November 25 for gathering support for Ram Temple at Ayodhya, at ‘Ishwar Deshmukh College of Physical Education’ without Nagpur University’s permission.
A division bench comprising justices Ravi Deshpande and Vinay Joshi on Wednesday, however, made the case “not before me” after which, it (No 146/2018) was shifted to second HC bench consisting of justices Pradip Deshmukh and Swapna Joshi.

It would come up for hearing on Thursday. The government has already roped in senior counsel Anand Jaiswal for pleading the case, while RSS is likely to engage senior lawyer Sunil Manohar to argue its side.

Moon, through counsel Ashwin Ingole, contended that RSS Sarsanghchalak Mohan Bhagwat and Mahanagar Sanghachalak Rajesh Loya represent a particular community. By holding the programme over contentious issue of building temple at Ayodhya, it would violate the fundamental rights of citizens of other communities as enshrined under Articles 21 and 25 of the Constitution of India.


Citing media reports, he also pointed out that the Supreme Court has fixed the matter for hearing in January. He made a representation to the respondents, including commissioner of police, for not granting permission to RSS to hold the event at the proposed venue on November 12, but no steps were taken.


Pointing out that the Krida Chowk-based college is an aided one, he argued that it shouldn’t be permitted to conduct political activities. Therefore, he had made similar representation to the university as well, but no cognisance was taken, forcing him to knock the judiciary’s doors.


The petitioner, who had earlier filed many PILs against the saffron organization, prayed for staying the ‘Hunkar Sabha’ to be held at Ishwar Deshmukh College. Apart from RSS, NU, CP and Ishwar Deshmukh management, divisional commissioner and collector have also been made respondents in the case.
