The Madurai Bench of the Madras High Court on Thursday directed the Secretary, Adi Dravidar and Tribal Welfare, to file a counter affidavit in a case pertaining to the community certificate of Puthiya Tamizhagam founder K. Krishnasamy.
A Division Bench of Justices K.K.Sasidharan and P.D. Audikesavalu adjourned the hearing till December 10. The court also took note of a counter affidavit filed by the Tahsildar of Coimbatore South Taluk in the case.
The Tahsildar said Mr. Krishnasamy claimed that he hailed from Kuniamuthur in Perur taluk. However, his school certificates stated that he was from Udumalpet. With the trifurcation of Coimbatore South Taluk into Madukkarai, Perur and Coimbatore South, the Tahsildar had no jurisdiction for verification in the case, the counter said.
The court was hearing the petition filed by S. Sivajayaprakash of Tirunelveli who claimed that Mr. Krishnasamy had fraudulently obtained a Devendra Kula Vellalar community certificate. He said the certificate was obtained from Coimbatore South Taluk. However, as per the school leaving certificate, Mr. Krishnasamy belonged to Udumalpet (now in Tirupur district).
A permanent community certificate could be issued by the Tahsildar of the respective taluk after ascertaining facts from the Village Administrative Officer. This was not followed in the case of Mr. Krishnasamy, he said and sought a direction to cancel the certificate.
