IN THE Sohrabuddin Shaikh and Tulsiram Prajapati alleged fake encounter cases, the  CBI informed the special court that Tulsiram’s mother Narmadabai, who was to depose on Monday, has sought more time to appear as a prosecution witness.

Special Public Prosecutor B P Raju informed the court that Narmadabai cannot appear as a witness, as one of her family members has fallen ill. She sought another date. The court has directed for her to appear on November 17.

Earlier, the special court had issued a non-bailable warrant against Narmadabai after she failed to appear, despite multiple summons. The Ujjain resident had filed a petition in the Supreme Court seeking an investigation after her son was killed in an alleged encounter on December 28, 2006.

Defence advocate Hiten Shah filed an application on Monday seeking corrections in the evidence recorded of witness Azam Khan last week.

Shah said Khan had mentioned the names of two men while speaking about the alleged murder of senior BJP leader and former Home Minister of Gujarat, Haren Pandya in 2003.

The court rejected the plea stating that the evidence was recorded as per the deposition of Khan. On November 3, during his cross-examination, Khan had said Pandya’s murder was committed by Prajapati and “one boy” at the instance of Sohrabuddin.

Shah said he had also mentioned the names of Naeem Khan and Shahid Rampuri, which the court had recorded during the examination-in-chief.
