Court teaches tutor a lesson, jails him for sex assault on minor

MUMBAI: Four years after a 53-year-old tutor had been accused of sexually assaulting his 15-year-old student, he was convicted of the crime and sentenced to five years. The special POCSO Act Court passed the judgment on Thursday.
The accused and the class X student were residents of the same building in Andheri (west) and the assault had taken place at the teenager's house soon after they had wrapped up a teaching session while her board exams were on.
The police told the court that the incident took place on March 15, 2014. The minor, who was then a student at a suburban school, was undergoing a crucial academic year. The tutor coached her in maths, physics and chemistry for about eight months until then. Each teaching session used to last about an hour at her home.
The minor had told the cops that the tutor visited their house around 7 pm on most days. But that day he had come in early as her final exams were going on and she had study leave. It was submitted that the student's parents had gone out and her sister was in the bedroom while her grandmother was in the kitchen.
It was further submitted that the day's tuition class ended at 10.45 am. As he was about to leave the student's house, he hugged her. She also said that when she struggled to push him away, the tutor touched her inappropriately. Alarmed, the teenager screamed and her sister and grandmother rushed into the room. That's when the tutor left the house.
The student then narrated the incident to her grandmother who called up her parents. They rushed home and the family then went to Versova police station and lodged a complaint. The tutor was arrested and later granted bail.
In March this year, the court had rejected his plea seeking discharge from the case. He told the court then that none of his other students had complained about him. He also submitted that the minor had cooked up a story as he had taken away her cellphone as she had been too engrossed in using it.
The court refuted the defence and relied on the girl's statement.
