A man who stabbed his mother to death because he was allegedly having a bad dream has been found not guilty of her murder.  

Lanell Latta, 50, was found stabbed to death in her home in Avalon, on Sydney's Northern Beaches, two days after a celebration for her partner Geoff Robson-Scott's 60th birthday.

Ms Latta's son Joel Woszatka, 25, was arrested nearby and charged with his mother's murder.

Woszatka faced the New South Wales Supreme Court on Thursday and was found not guilty by reason of mental illness.

Justice Helen Wilson ruled Woszatka 'cannot be held criminally responsible for the death of Ms Latta, or for the assault upon Mr Robson-Scott'.

'It is very clear that the accused has been severely ill since, at least, 2015, when he first presented in a psychotic state to Manly Hospital. 

'He harboured homicidal ideation towards Mr Robson-Scott, and having given voice the previous day to an hallucination that God had told him to kill his mother.

'Whilst there have been occasional improvements to his condition as it manifested at that time, when treated assertively with anti-psychotic medication, it is also clear that the condition has endured, despite treatment.'

Woszatka ceased taking his anti-psychotic medications in March 2017 because he 'never saw himself as requiring medication, and was content to take it no longer.'

Woszatka consistently had trouble keeping on his medication. 

In February 2015 hospital notes showed that Ms Latta reported to staff that her son had told her that 'god' was told him to kill her which lead to him reaming in hospital.

Court documents stated that based on the evidence there was 'no doubt' that Waszatka did indeed stab his mother once in the chest which directly lead to her death. 

His insistence on not taking his medication for an extended period of time was also a contributing factor in his mental illness at the time of his mother's death, the court stated.
