Farmer held for giving triple talaq to pregnant wife

Surat: Umargam police in Valsad district arrested a 32-year-old man who deserted his seven-month pregnant wife by giving her triple talaq in writing and uttering the same in her absence in a mosque, following a bitter marital discord.
Accused Azharuddin Patel, a farmer living in Sanjan village, divorced his 21-year-old wife Afreen after she had lodged a complaint of harassment against him and his three family members in September. Afreen had lodged the complaint on September 28 when she tried to commit suicide by consuming chalk sticks used for pest control. Police had arrested Patel and his siblings following the complaint and they were sent to judicial custody.

Afreen approached the police again on October 29 when the trustee of Navi Masjid Sunni Muslim Jamat informed her that Patel had given her talaq in writing. She was also given a photocopy of the talaqnama.

On October 30, police arrested Patel, who was out on bail in the harassment case and sent him to judicial custody.

“This was a strong case of triple talaq in which the accused had pronounced talaq in writing. Since it is a criminal offence, police registered the case and took action,” said Sunil Joshi, superintendent of police, Valsad.

In the talaqnama submitted to the mosque, Patel said that Afreen had levelled serious allegations against his character as a result of which his sisters and family members had to face disgrace.


Patel was was booked under section 4 of the The Muslim Woman (Protection of Rights on Marriage) Ordinance on October 29. The section states that any Muslim husband who pronounces talaq by words, either spoken or written or in electronic form or in any other manner whatsoever, shall be punished with imprisonment for a term which may extend to three years and shall also be liable to fine. The ordinance was promulgated by President of India on September 19.


Police investigation so far revealed that Afreen and Patel got on December 26, 2017. After spending initial months of married life happily, disputes started developing between the couple. Two months ago, Afreen went to stay with her sisters who also live in Sanjan.


Her father is currently working as a contractor in Saudi Arabia.
