Madras HC stays criminal proceedings against DMK MLA Periyasamy

MADURAI: The Madurai bench of the Madras high court on Tuesday stayed proceedings against DMK legislator I Periyasamy in a trial court in connection with a case filed by the Nilakottai police in 2014.
The legislator approached the high court seeking to quash the case against him, claiming that it had been foisted against him due to political vengeance.
According to the chargesheet filed by the Nilakottai police, Periyasamy - then the DMK’s Dindigul district secretary - abused police personnel in a speech. He was booked under sections, including 189 (threat to public servant) and 290 (public nuisance) of the IPC.
In his petition, Periyasamy stated that though the speech took place on August 2, 2014, the police registered the case only a month later, which itself clearly established the allegations were false.
The DMK leader sought the court to dispense with his personal appearance before the trial court and quash the proceedings.
Justice N Anand Venkatesh admitted the proceedings and granted interim stay on the proceedings before the trial court.
