NOIDA: The National Human Rights Commission (NHRC) has recommended to the UP government that Rs 5 lakh be paid to the family of Noida-based gym trainer Jitendra Yadav who has been bedridden since being shot at by a trainee sub inspector, Vijay Darshan, in an alleged fake encounter on the night of February 3, 2018.
The NHRC has also asked the UP chief secretary to submit a compliance report along with proof of this payment within six weeks.
Darshan and constables Sanjay Tamta, Narendra and Pankaj Singh had allegedly physically assaulted Jitendra after a tiff and bundled the latter in the back seat of his Scorpio that he was driving towards Sector 122. However, the argument between them heated up and Darshan took out his revolver and shot at Jitendra in his throat. The bullet pierced his body and spine.
Taking a suo motu cognisance of media reports about the shoot out, the NHRC had registered a case on February 5. “Post the findings and the action initiated against the erring police personnel, the commission held that a case of human rights violation is made out and the state government is vicariously liable to pay monetary relief to the next of kin of the victim,” the statement said.
However, according to the commission, the UP government failed to respond to the notice. “Having received no response to the show cause notice, the commission concluded that it shows that the state government had nothing to say in the matter and hence recommended a payment of Rs 5 lakhs as relief,” it adds.
Meanwhile, Jitendra welcomed the NHRC decision stating that till now help had flown in only from former UP chief minister Akhilesh Yadav and Samajwadi Secular Morcha leader Shivpal Yadav. Both had handed over Rs 10 lakh each to Jitendra’s family.
