'Tears of victim' convinces Sessions court, results in guilty verdict

The Session's Court has pronounced an accused guilty in a Protection of Children against Sexual Assault (POCSO) case, saying the victim's statement alone was enough to pass the verdict.

The court held that the victim was crying continuously while narrating the incident before the court, which led it to believe her statement was the truth, and it was enough to hold the man guilty of the charges.

The court also pointed out that an FIR was registered a month after the crime was committed; the assault took place in July 2017, while the FIR was lodged in August. "The victim was working as a maid at the accused's place, where she was sexually assaulted. It's obvious that the victim didn't have the courage to immediately approach the police and report the incident, as she was afraid," the court said.

The prosecution said the girl was brought to Mumbai by her earlier employer to take care of his grandchildren, whose mother was on medication to treat a skin condition, which caused her to experience dizziness. The husband of the woman, however, sexually assaulted the victim between July 27 and July 29, 2017.

The court held the man guilty and sentenced him to 20 years' imprisonment.
