LUCKNOW: In a report filed in the court of chief judicial magistrate Anand Prakash Singh on Monday, Lucknow Police have again dismissed allegations that Samajwadi Party patriarch Mulayam Singh Yadav had issued any threat to IPS officer Amitabh Thakur in 2015.
Police re-endorsed their final report submitted in the case earlier while seeking closure of the case on grounds that charges levelled against Mulayam could not be substantiated.
Samajwadi Party patriarch Mulayam had admitted that he called up the IPS officer but said that he only gave 'elderly' advice.
Thakur had lodged a complaint with Hazratganj police in July 2015 accusing Mulayam of calling him on his mobile on July 10 and threatening him.
A case was registered under section 506 (criminal intimidation) of the IPC in connection with the complaint on court orders.
Police filed a final report in the case in October 2015, but Amitabh Thakur moved the court seeking re-investigation.
The court then directed police to probe the allegations again, take voice samples of the two parties and get them matched forensically.
It was in compliance with this court order that police have now submitted this report.
In its report dated October 12, 2018, investigating officer (IO), circle officer Bazarkhala Anil Kumar Yadav stated that as per directions of the court to probe the case and collect Mulayam's voice sample, he visited the SP patriarch's residence at Sushant Gold City on August 4. Mulayam refused to give his voice sample but he accepted that he did talk to the IPS officer and added that it was only an elderly advice and not a threat.
Circle officer Bazarkhala said that since Mulayam admitted that he had called up Amitabh Thakur, there was no reason to press for his voice sample. "We re-endorsed the final report filed earlier," Yadav told TOI.
Police also requested the court to start proceedings against Thakur under section 182 of CrPC for lodging false complaint against Mulayam.
In case, the court finds that Amitabh had lodged false complaint, it can award him six months imprisonment and impose fine of Rs 1,000.
Taking the FR on record, the CJM fixed November 15 for passing order on the final report.
