Sessions Court lets off 65-year-old in husband's murder case

The Session's Court refused to accept that a 65-year-old lady killed her 75-year-old husband after spending their lives together for so many years, thus granting bail to the senior citizen. The court while passing its order held that the accused is in prison for more than six months and when the case is entirely based on circumstantial evidence, it is not proper to detain a senior citizen until trial is concluded.

As per police claims the accused allegedly killed her husband with a paver block and later threw it away near the garbage bin on main road. Police collected the paver block three days after the alleged incident took place. The court held that it is impossible to collect the same block from the spot as the garbage has been cleaned by civic authorities on a daily basis, which therefore weakens the prosecution's case in the first place.

"There is no direct evidence in the case. The accused being a lady of 65 years of age could not have possibly overpowered her husband to assault him with a paver block, thus causing his death. She cannot be apprehended at this juncture at all," the court held.

According to the prosecution, the accused Dhannudevi Mourya, on April 1,2018, while they were on their way to Dombivali, to check a new rented house, allegedly assaulted her husband Chottelal Mourya which led to his death. The complaint was registered against the accused by her son.
