Passage of Bill paves way for BPS implementation

Taking serious view of mushrooming of unauthorised layouts and unauthorised buildings in urban areas, the State government has decided to regulate such constructions through the Building Penalisation Scheme (BPS).

A decisive step was taken in the Assembly on Tuesday to pave the way for the implementation of the BPS with the passage of the Bill to amend the existing municipal Acts.

‘Pragmatic solution’

Moving the Bill, Municipal Administration and Urban Development Minister P. Narayana said that the government has come up with a pragmatic solution, penalisation of unauthorised constructions and deviations in sanctioned plan in order to bring the unauthorised constructions into planning fold and also to remove the threat or fear of demolition.

It was an opportunity for the public to get their unauthorised constructions regulated, he said.

The objective of the amendment was to penalise each and every building constructed unauthorisedly or in deviation of the sanctioned plan so as to create deterrence against any such practice. Also to bring all the unauthorised constructions in to planning fold and to regulate the development areas. It was also necessary to provide relief to several persons who purchased such buildings in good faith, he said.

The Minister said relevant laws have been amended by Act No. 9 of 2008 and by Act No. 6 of 2016, and statutory rules were issued for implementation of the Compulsory Disclosure Scheme for penalisation and regulation of unauthorised buildings and buildings constructed in deviation of the sanctioned plan, he explained.

The Municipal Corporations Act, 1955, the Andhra Pradesh Municipalities Act, 1965, The Andhra Pradesh Capital Region Development Authority Act, 2014, and the Andhra Pradesh Metropolitan Region and Urban Development Act, 2016 would be amended with the Bill passed in the Assembly.
