Hyderabad: Court reserves its judgement on Kinley labelling

HYDERABAD: The rules pertaining to legal meteorology's package and commodities have to be interpreted keeping in view the situation of unfortunate Indians who are forced to buy even potable water in bottles, a Hyderabad High Court bench said on Monday.

The bench of Chief Justice T B Radhakrishnan and Justice S V Bhatt said this while reserving its judgement in an appeal filed by Telangana civil supplies and legal meteorology wings questioning the relief given by a single judge to a private water bottling unit at Patancheru which was bottling Kinley water bottles without following the prescribed rules.

The authorities seized seven lakh Kinley water bottles since the company had not furnished details on the labels. When the company challenged this, a single judge ordered the release of the seized bottles. The government filed an appeal against this order.

According to Jyoti Kiran, the government pleader for Legal Meterology wing, the bottling unit or the company has to convey in its label details of manufacturer, office address, email ID and phone number of the company for consumers to complain.

Senior counsel A Sudarsan Reddy appearing for the bottling company said that they have complied with the rules. Assistant Solicitor General K Lakshman said that the company has to mention on its label who will receive complaints from consumers.

The bench too said that the rules prescribe that the manufacturer has to disclose all details and that disclosure should be a sufficient disclosure. This is essentially a rule aimed at consumer protection, the bench said and reserved its judgement.
