A Delhi court has sentenced five persons to life imprisonment for murdering a man on a trifle issue at Bhalswa Dairy in north Delhi in 2016.
The police had lodged a case based on a complaint made by the mother of the deceased. She said that the accused had entered the victim’s slum and started stabbing him, adding that one of the accused and the victim had a fight between them a few hours earlier.
The accused fled after the victim’s mother raised an alarm. The victim was immediately rushed to a nearby hospital where he was brought dead.
The victim had narrated the incident to one of his sisters while he was being taken to the hospital.
Additional Sessions Judge V.K. Bansal convicted the accused on the basis of the dying declaration of the victim, the eyewitness account of his mother and circumstantial evidence.
“Keeping in view the discussions on various circumstances, the eyewitness’ account and the dying declaration [of the victim] proved on record. In my opinion, prosecution has proved and established that the accused persons facing trial along with the other accused, who have not been arrested, formed an unlawful assembly to commit the offence of murder,” the Judge said.
The Judge, while convicting the accused, also rejected their plea for a lenient punishment.
Rigorous imprisonment
“All the convicts are sentenced to undergo rigorous imprisonment for life for the offence punishable under Section 302 read with Section 149 IPC with fine of ₹5,000,” Mr. Bansal said.
“In this case a mother has lost his son in the prime of his youth. Her loss cannot be compensated in terms of money in any manner, but still to give some consolation to her, the present matter is referred to the North DLSA Secretary, keeping in view the poor condition of all the convicts, to grant compensation to her,” the Judge further said.
