Dosti Acres landslide: HC questions BMC’s rule changes

Mumbai: The Bombay High Court on Monday issued notices to the Brihanmumbai Municipal Corporation (BMC) and the Urban Development Department for unconstitutional amendments to the basement rules, which led to the Dosti Acres landslide in June.

A Division Bench of Justice B.R. Gavai and Justice M.S. Karnik was hearing a public interest litigation (PIL) filed by advocate Abha Singh challenging the unconstitutional amendments made to the development control regulations.

The PIL alleged that the BMC made the amendments to the basement law to suit builders by deleting depth, basement area, and open space limits.

Last month, the HC had directed that a three-member panel be constituted to implement the measures suggested by the Indian Institute of Technology Bombay after a study on the collapse.

The panel of a civic officer and two experts from IIT-Bombay had suggested certain interim measures like a refraining wall, weep holes, and struts, which will provide support to the wall.

The court had said that the committee will supervise the work of remedial measures.
