Despite concerns raised by some Supreme Court judges, Uttarakhand CJ Justice KM Joseph will take oath as per the order fixed by the Union government. He is scheduled to be sworn in last after Justices Indira Banerjee and Vineet Saran. Some SC judges wanted him to take oath first, as his name was recommended in January along with senior advocate Indu Malhotra, who is now a SC judge. Justice KM Joseph's name was then returned by the Centre, saying he wasn't senior enough. The collegium then returned justice Joseph's name along with those of Madras High Court Chief Justice Indira Banerjee and Orissa HC CJ Saran. Rejecting concerns expressed by some SC judges that the Centre is trying to alter the seniority level of judges, the govt says that seniority among judges is decided by the position in the all-India judges’ seniority list. In this list, Justice Banerjee is at 4th position, Justice Saran is at 5th position, while Justice Joseph is at 39th position.
