HC directs police not to act against 5 more nightclubs in Gurugram

CHANDIGARH: The Punjab and Haryana high court on Wednesday directed the police not to take any coercive action against five more clubs/bars running in Gurugram city. The administration had issued these clubs/bars notices on July 24 regarding cancellation of NOC for not following some regulations.

“Identical matter with the same impugned order passed by the commissioner of police, Gurugram, is pending in separate petition in which notice has also been issued for August 23,” the HC observed while extending the interim relief to fresh petitioners.

Justice Rajiv Narain Raina passed these orders while hearing a petition filed by Prison Club, IPSA Hospitality and others who are running clubs in Gurugram city.

With this, all the petitions related to the issue will now come up for hearing on August 23 along with the main petition filed by ‘Empire’, and ‘Queens Club’, running at MGF Metropolitan Mall, Gurugram.

According to the petitioners, the July 24 order of the commissioner of police, Gurugram was in excess of jurisdiction and is a knee jerk reaction when it withdraws the NOC issued to clubs.

It has also been submitted that the order has been passed without notice or offering hearing to the petitioners. Besides, it has caused serious loss of business to the petitioners.
