The Supreme Court today will review its decision to stop inquiry into the death of justice BH Loya who was hearing the Sohrabuddin Sheikh encounter case.
The apex court dismissed petitions seeking probe into the death of Justice Loya, calling them "attempts to scandalise the judiciary," while ruling the judge died of 'natural causes' in its verdict on April 19 this year.
A petition was filed by the Bombay lawyers Association in the top court in May seeking review of its verdict rejecting the demand for an independent probe into the death of the CBI judge.
The court today will give the matter a private hearing "in chamber" today, reported the NDTV.
Loya, who was hearing the high-profile Sohrabuddin Sheikh fake-encounter case, had allegedly died of cardiac arrest in Nagpur on December 1, 2014 when he had gone to attend the wedding of a colleague's daughter. Petitions seeking a probe into his death were filed in the Supreme Court.
In its April 19 verdict, the apex court bench headed by Chief Justice Dipak Misra had ruled that Loya died of "natural causes" and there was no ground for the court to hold that there was reasonable suspicion about the cause or circumstances of death which would merit a further inquiry.
The review petition by the Bombay Lawyers Association said this judgement "resulted in miscarriage of justice, if not complete negation of justice on the facts of the case. It is therefore clearly required in the interests of justice that the judgment and order in question be reviewed and recalled."
