BCCI clips the kiss, Facebook blocks her accounts

CHANDIGARH: Uploading a 10-second TV clip of her blowing a kiss while she watched India take on Sri Lanka at the PCA Stadium in Mohali on December 13, 2017, has blown away her Facebook account. That is because BCCI called it a violation of its copyrights and ticked off Facebook, which willingly deactivated two accounts of the Sector 49 resident. The 27-yearold has now moved the court, asking it to direct the social networking company to reactivate her accounts.





Catching herself being telecaston thebig screen during the match had bowled over Monika Shail. But she was stumped to learn that there could be consequences of sharing her moment of fame on her FB page “Monika Shail” at 1.29 am on December 14, 2017.

On December 16,2017,she received an email from Facebook telling her that her accounts hadbeen deactivated. Facebook mentioned that it has received a noticefrom theBCCIstating the content uploaded by her infringes the copyright(s) of the cricketbody.

The Facebook notice further stated if Monika resolved the dispute with BCCI, only then her reported content or Facebook accounts could be restored. On December 20, 2017, she replied to the BCCI that she had deleted the video and pointed out that she had posted the video out of joy. She also requested BCCI to help her in getting her accounts activated and offered to apologise in writing. But she got no response, prompting her to knock on the doors of the court.

Monika, in her petition through her counsel Rajesh Sharma, said she has a Facebook account in the name of “Monika Shail” and a business page in the name of “M S Visa Experts”, through which she managed her business. She said she has over 400 friends and 8,500 followers on her Monika Facebook account and about 1,500 to 1,600 followers on her business account. “Disabling the Facebook accounts have resulted in loss and injury to my mind, reputation and business,” she argued in her petition. Her petition has also demanded that BCCI be directed to give its consent to Facebook for restoring her account.
