The
Punjab and Haryana high court has refused to set aside the clause of the
Haryana Gauvansh Sanrakshan and
Gausamvardhan Act, 2015, which permits selling of beef in the state for medicinal purpose.
The petitioner in the case wanted the HC to strike down the clause on the grounds that cow beef did not have any medicinal value and selling it was against the constitutional provisions regarding freedom of religion.
“Even otherwise, no
certiorari can be issued for quashing any provision of any enactment, and for this reason also the relief prayed for is not liable to be granted. The petition is devoid of merit and accordingly stands dismissed,” held the HC.
