CHENNAI: THE Madras High Court has directed the State government to make suitable changes in the recent GOs, which restructured the administrative set up at the field level and delegated disciplinary and administrative powers to them for effective monitoring and to enhance the quality of education.
Justices Huluvadi G Ramesh and M Dhandapani gave the directive recently, while disposing of a batch of writ petitions from P Ravi, ex-councillor of Yercaud and two others. Considering the various grievances and infirmities, the bench said the amendments should be done within two months as a correctional method in accordance with the relevant rules. The petitioners are at liberty to make representations to the government pointing out the infirmities, the bench added.The judges, however, refused to interfere with the GO.
Earlier, senior advocate P Wilson and advocate G Sankaran, appearing for the petitioners, submitted that a post borne in the cadre in particular service was conferred with powers and responsibilities as per the Service Rules and cannot be authorised to carry out the functions coming under different services governed by separate powers. Private schools are governed by provisions of Tamil Nadu Recognised Private Schools (Regulation) Act, 1973 and the rules under it in 1974. Anglo-Indian Schools are governed by the Code of Regulations for Anglo-Indian Schools, Tamil Nadu.
The impugned GOs will come in the way of administration of the institutions, which is contrary to the practice hitherto followed. Without adhering to Articles 29 and 30 of the Constitution, which gives complete independence to the administration and management of Anglo-Indian Schools and Linguistic Minority Schools, the GOs had been passed, counsel contended.
