JAIPUR: The
Rajasthan high court has ordered the police to do away with the “abhorrent practice” of mentioning the caste of an individual in
arrest memos and bail applications.
The court observed that identifying a person by caste is neither allowed by CrPC, nor provided by any law under the aegis of the Constitution. The bench of Justice S P Sharma gave the direction while hearing a criminal miscellaneous petition seeking correction in the caste of an accused under the Excise Act. The accused had been granted bail but the (bail) bond could not be executed as his caste mentioned in it was not matching with records.
