Taking a dig at Delhi Chief Minister Arvind Kejriwal, the BJP today said he is celebrating his "loss" as the Supreme Court has rejected the demand for absolute powers for his government.
The SC judges must have Kejriwal on their mind, when they wrote against anarchy as the Aam Aadmi Party leader is a "self-declared anarchist", Patra quipped.
He termed the court judgement a good news and asked the AAP leader to focus on discuss and deliberations and not on dharnas.
"Why is he celebrating," Patra asked.
The court has said that the Delhi government should have some required degree of independence subject to limitations of the Constitution, Patra said, arguing that the AAP dispensation always had this freedom.
That is why Kejriwal has spent crores of rupees in the publicity of his government's works, the BJP leader said.
The council of ministers will have to inform the LG about their decisions, he said, citing the order.
In a landmark verdict, the Supreme Court today unanimously held that Delhi cannot be accorded the status of a state but clipped the powers of the Lieutenant Governor (LG), saying he has no "independent decision making power" and has to act on the aid and advice of the elected government.
The court has spoken about well-deliberated and legitimated decisions of the state's council of ministers, Patra said, claiming that it if it "politically deliberated" then they will be subject to verification by the office of President on the LG's reference.
It is natural that if the state government takes correct decisions, then no one will stop it, he said.
Patra cited the court's reference to constitutional morality and harmony to attack Kejriwal, claiming that his personal attacks, including on Prime Minister Narendra Modi by using terms like psychopath and coward, show that he hardly believes in harmony among different authorities.
Almost half of Kejriwal's ministers have been sacked on the grounds of constitutional immorality, he said, referring to criminal cases against several AAP leaders.
The essence of the court's verdict is that the Constitution is sacrosanct and constitutional morality is extremely important, Patra said.
"It has been Kejriwal's method to interpret the Constitution subjectively. If somebody is celebrating win even after his loss, then his name is Kejriwal," he said.
The Delhi chief minister cannot make any excuse now after this judgement which has "exposed" him, he claimed.
The court has said there is no space for anarchy and constitutional immorality is the word that find the centre stage in its verdict which, Patra said, points to the AAP government.
