HC orders prohibition on ‘misbranded’ items

In yet another major decision, the High Court of Uttarakhand has banned the sale of food products being sold on the basis of misleading information. The HC division bench has directed the chief medical officers of all districts to enforce a ban on sale of such products in their respective districts.

If any shopkeeper is found selling such food items, legal action will be taken against him/her.

Additionally, the court has ordered that companies manufacturing such products in the state should be shut down. Rishikesh resident Sunil Datt had filed a petition in the HC stating that products like lemon soda, cold drinks and other food products which could be detrimental to public health were being sold in the state.

The petitioner had sought a ban on the sale of such items in the state.

In its order, the division bench of justices Rajiv Sharma and Lokpal Singh ordered a prohibition on such items which can be categorised as ‘misbranded’.
