The Karnataka High Court on Thursday asked the counsel for State and Union governments to seek instructions from the respective authorities on a PIL, which has questioned the correctness of consensual agreement signed by the State government with private engineering and architecture colleges.
A Division Bench comprising Chief Justice Dinesh Maheshwari and Justice Krishna S. Dixit before whom the petition, filed by M. Ramesh Naik, a resident of Bengaluru, came up for hearing has adjourned further hearing till July 25. Contending that the State’s education policy has several anomalies besides being contrary to the apex court’s directions, the petitioner has said that the consensual agreement between the State government and the private professional college managements on seat sharing and fee structure since 2006 has led to collection of higher tuition fee by the colleges under the management and the NRI quota sans any upper limit.
Transfer of teachers
The High Court on Thursday vacated the stay, granted in May this year, against transfer of primary and secondary government school teachers. A Division Bench comprising Justice H.G. Ramesh and Justice Mohammad Nawaz vacated the interim order granted in a petition filed by Prabha Adigal, a teacher, who had questioned the Rules and Circulars issued earlier this year allowing transfer of teachers from one zone to another zone. It was contended on behalf of the petitioner that provision for transfer from one zone to another is contrary to the provisions of the Karnataka State Civil Services (Regulation of Transfer of Teachers) Act, 2007, which does not permit inter-zone transfers.
However, the government on Thursday pointed out to the court that the KSCS (Regulation of Transfer of Teachers) Act was amended in April 2017 allowing inter-zone transfers. Following this submission, the Bench vacated the stay.
