KINGSTON – Jamie Smith has had it with this.
The 33-year-old Kingston woman said she’s been stalked and creeped out by Robert D. Miller, a 74-year-old man released for a third time on his signature Thursday afternoon. He’s due back in court at 3 p.m. Monday, and his attorney, Brian Wright, said Thursday he’s applying for mental health court.
Miller, of the 31100 block of Oakview Lane, was released on his signature in July 2017 after police said in court records he’d taken photos of Smith at the Genoa Pool, 400 E. Second St. He also was ordered to have no contact with Smith or her family members. Court records show an extended order of protection was filed in August 2017, and Miller pleaded not guilty to charges of disorderly conduct and stalking – typically punishable by one to three years in prison – in September.
Smith said that was one of multiple times Miller stalked her at the pool.
The records show Miller was charged with violating an order of protection in December 2017 for being at McDonald’s while Smith was there, and again was released on his signature.
“Five hundred feet is 500 feet,” Smith said. “I don’t care who you’re with or why.”
She said Miller has been banned from the Park District, the pool and McDonald’s.
Miller again was arrested about 10:16 a.m. Wednesday at a rest stop at state routes 23 and 72 on a warrant for a violation of an order of protection. According to a report from the Genoa Police Department, Smith said she was at Butera Market, 600 Pearson Drive, Genoa, about 12:30 p.m. June 2 when she saw Miller pull in on his motorcycle.
Miller told police he was just there to buy milk and cheese, and that he never saw Smith.
Smith said that’s highly unlikely, and that Miller has stalked her at multiple places around town, from the grocery store to youth sports events around town.
“Either we pull in at the same time, or I pull in and he’s there five minutes later,” Smith said.
She said she’s known of Miller for several years – “It’s a small town, and everyone knows everyone,” she said.
Smith’s husband, Eric, with whom she has three children, took to social media after Smith posted about Miller.
“We have no sympathy to this man,” Eric Smith said. “He came into our lives uninvited and turned my wife’s world upside-down. We have no room for debate with anyone who wants to defend him.”
