Justice A.V. Sesha Sai of Hyderabad High Court on Tuesday passed an order banning sale of flats built in lands of different survey numbers in Gopalnagar House Building Society of Hydernagar in Kukatpally. The order also prohibited further constructions at the said sites.
The Judge passed the order after hearing the arguments of GHMC Counsel Sampath Prabhakar Reddy in a writ petition filed by some builders who constructed hundreds of flats in the lands at Hydernagar. The petitioners moved the High Court praying for an order to protect the flats they had built, alleging that GHMC officials were creating disturbances over some dispute.
Mr. Reddy submitted to the HC that the lands on which the petitioners had built apartment blocks belonged to the State Government and they were built without permission. He submitted to the Judge that the GHMC had already razed some of the structures and the petitioners were trying to build them again by securing an order. While the petitioners maintained that they got the structures regularised in 2010, Mr. Reddy argued the documents relating to regularisation were fake.
He presented to the Judge that the GHMC had already suspended a Town Planning Supervisor and transferred two Assistant City Planners for remaining mute spectators over the “illegal constructions”. The Judge directed the petitioners to file counters within two weeks.
