The Karnataka High Court on Wednesday quashed criminal proceedings against former gangster Agni Sridhar and seven others in a case related to posing a threat to the life of a man, after the complainant and the accused persons jointly signed an affidavit to end the proceedings.
Justice K.N. Phaneendra quashed the criminal proceedings after all the accused persons and the complainant personally appeared in court, along with their advocates, and presented the jointly signed affidavit.
It has been stated in the affidavit that the complainant, who is known to the accused persons, had lodged a complaint of ‘threat to life’ due to some misunderstanding amongst themselves, and all of them want to lead a happy life by putting an end to the misunderstanding.
K.S. Rohit alias Onte, Sunil alias Silent Sunil, Syed Aman alias Ahamadulla Sharieff, N. Narasimhamurthy, Sateesh, M.C. Umesha and Vishnuvardhan alias Vishnu are the other accused against whom proceedings were quashed. The court directed the prison authorities to release Sunil immediately if he is not wanted in other cases.
The criminal proceedings were initiated by a magistrate court based on a chargesheet filed by the Yelahanka police following a First Information Report (FIR) lodged by Ramesh C. alias Tata Ramesh on February 5, 2017. The police had raided the house of Agni Sridhar on the charge that he had given shelter to some of the accused persons.
The court quashed the criminal proceedings as there was no legal impediment to put an end to the case by compounding the alleged offences under the Indian Penal Code while also noticing that the police had not taken mandatory sanction from the competent authority for prosecuting the accused under the Arms Act.
