A Wichita Falls man is accused of "mule kicking" an officer in the groin who was trying to transport him for a mental health evaluation at the state hospital.

Kevin Jerrell Osborne, 24, is charged with resisting arrest or transport, assault on a public servant and attempting to take a weapon from a peace officer.

He remained in the Wichita County Jail Tuesday afternoon in lieu of $11,000 total bail.

According to probable cause affidavits:

Around 1:06 p.m. on June 6, Wichita Falls police were sent to the Wayfarer Motel, 600 Central East Fwy., for a check welfare on a man who was sitting outside a room crying.

When responding officers attempted to talk with the man, he would not speak to them and was acting erratic.

The man would reportedly crouch down on all fours and drape his clothing over the balcony as if he was hiding from something or someone.

At that point, the officers went to speak to the hotel's management, who provided the officer's with a copy of the man's South Carolina identification card, which identified him as Osborne.

Officers tried to speak to the man again, but he still would not speak to them or make eye contact with them. When one of the officers would take the clothing items down from the railing, Osborne reportedly scrambled around to get more clothing to replace it.

Additional officers were requested to the scene since Osborne was not acting rationally.

Once backup arrived, the officers attempted to take Osborne into custody to be transported to the North Texas State Hospital for a mental health evaluation.

As soon as the officers reached for Osborne, he began flailing his arms and kicking his legs in an attempt to get away from them. They were able to get hold of his arms and one leg.

An officer tried to get Osborne's other leg, but Osborne "mule kicked" him directly in the genitals, "causing me pain."

Osborne was reportedly told numerous times to stop resisting and to quit kicking.

He was then arrested and charged with resisting arrest or transport, and assault on a public servant.

The officers eventually had to use leg restraints on Osborne, who was trying to kick out the windows of the marked patrol vehicles.

Osborne had to be physically carried into the county jail by several officers because he continued to resist arrest.

While they were carrying him into the jail, Osborne began reaching for one of the officer's firearms. He was reportedly able to place his fingers between the retention guard and retention release on the gun holster.

At least one officer and jailor witnessed Osborne reaching for the firearm, and the other officer could feel him "grabbing at his belt."

Osborne was then charged with the additional offense.
