Following a controlled text-messaging conversation between an accuser and rape suspect, police arrested the latter on a sexual battery charge in spite of the suspect's insistence that he likes rough sex and that his date had given him mixed signals.
Benjamin Galloway, 23, of Port Orange, was picked up Thursday on a warrant issued May 24, according to court records. He was released Friday morning after posting $10,000 bail.
The accuser told the Volusia County Sheriff's Office that she had gone on a date with Galloway in January and agreed to go back to his house, which at the time was in Deltona, deputies said.
Galloway forcibly kissed the woman, grabbed her by the throat, pushed her down, grabbed her by the hair and forced her into his bedroom all while his roommates were sleeping, according to a charging affidavit.
It was while the pair were in the bedroom that Galloway forced her to perform a sexual act on him by repeatedly slapping her in the face, deputies said.
Galloway continued to force himself on her until she was able to escape his grasp and run out of the house, deputies said.
Sometime later, detectives coordinated a controlled text conversation between the accuser and the suspect. A transcript of that conversation was included in the arrest affidavit.
"I think some signals go mixed," Galloway wrote. "I thought you were into it, (to be honest)."
"What makes you think I was into it?" the woman responded. "Was me telling you 'no" and throwing up not enough of a signal?"
The accuser reminded Galloway that she was crying during the encounter and that should've been another signal that she was not consenting to anything sexual, deputies said.
A phone message left with Galloway was not returned Friday. Galloway has no arrest record in Volusia County.
