Mumbai: The Bombay High Court on Tuesday asked the State government to clarify its stand over the regulation of illegal nursing homes in the state. The HC has asked the Advocate General to inform it why the government was showing reluctance in enforcing the rules framed by the Union government to regulate hospitals and nursing homes.
A division bench of Justice Naresh Patil and Justice Girish Kulkarni said, “We fail to understand as to why the State government is not adopting the rules framed by the Centre. Why is it reluctant to implement the rules and why is the government succumbing to pressure of the medical fraternity?”
The remarks were made by the judges while hearing a PIL filed by Atul Bhosale, a Pune resident. The PIL sought enforcement of the Clinical Establishments (Registration and Regulation) Act, which was introduced by the Union government in 2010. The Act mandates the registration and regulation of all clinical facilities in the country.
In his PIL, Bhosale highlighted the poor conditions of hospitals and nursing homes across the state. He claimed the government hadn’t implemented the 2010 Act till date and had failed to enforce its very own Maharashtra Nursing Homes Registration Act. The next hearing will be on June 8.
