NEW DELHI: The JD(U) today moved the
Supreme Court (SC) to get rebel Parliamentarian
Sharad Yadav to vacate his official residence. The SC will hear the plea tomorrow.
In moving the top court, the JD(U) challenged a Delhi high court (HC) order allowing him to use the official residence until the court decides on a plea from Yadav challenging his disqualification from the
Rajya Sabha.
The JD(U) believes that former party president Yadav's disqualification - on December 4 last year - as a Rajya Sabha member was valid as he has formed another political party. The Delhi high court last month listed the matter - Yadav's plea challenging his disqualification- for further hearing on July 12.
Yadav joined hands with the opposition after the JD(U) president and
Bihar chief minister,
Nitish Kumar, had dumped the alliance with the RJD and the
Congress in Bihar and tied up with the BJP in July last year.
Yadav was elected to the Rajya Sabha last year and his term is scheduled to end in July 2022. He was disqualified under the Anti-Defection Act. His plea said that the December 4, 2017 order had disqualified him in an "extremely casual and callous way".
