Bhopal: Government staff unions hail SC verdict on quota in promotion


Bhopal: Government staff unions have welcomed Supreme Court decision to allow the Union government to proceed with the reservation in promotion for employees belonging to the SC and ST category in “accordance with law”.

SC/ST officers/ employees’ unions and General/OBC officers unions thanked the apex court for its decision which came on the Centre’s plea that challenged the High Court’s August 23 order of last year whereby the latter had restrained the Union government from granting any reservation in promotion to SCs/STs.

Hailing the SC judgment, Anusuchit Jati Janjati Adhikari Karamchari Sangh (AJJAKS), Anusuchit Jati-Janjati Pichharaverga Adhikari-Karamchari Sangh(APAKS) said that High Court decision to revert officials was not justified. While Samanya Pichhara, Alpsankhyak  Adhikari-Karamchari Sangh (SPAAKS) welcomed the top court verdict, however, demanded implementation of judgement in M Nagaraj case as SC has favoured reservation in promotions as per the law.


In fact, Supreme Court has allowed the Union of India to proceed with the reservation in favour of SC/ST employees “as per the law” in matters of promotion, until the final disposal of the controversy by the constitution bench.

MP Advocate General Pursendra Kaurav said that the state will move an application in Supreme Court seeking the implementation in Madhya Pradesh too. AJJAKS state president Bhuvanesh Patel said, “We welcome Supreme Court decision which has supports our stand. Terming the High Court decision over the issue totally wrong, Patel said that the court had quashed the government’s order extending reservation in promotion to employees belonging to SC/ST and it had also advocated to revert the officials who had given benefit under the clause.  To return any one, is not justified from any angle. There must be amendment in Constitution for it, he added”

APAKS general secretary SL Survanshi said, “We welcome the decision of the Supreme Court which has allowed central government to continue reservations in promotion. It is up to Madhya Pradesh government to comply with the SC order.”

Samanya Pichhara, Alpsankhyak  Adhikari-Karamchari Sangh (SPAAKS) general secretary Ajay Jain said that SC has clearly said that reservation in promotion should be given but as per law, it is matter of interpretation. “We never opposed reservation in promotion but it should be as per law. Delhi high court had passed the verdict in the light of the apex court constitution bench judgment in M Nagaraj (2006) case. SPASKS also demand implementation of same verdict,” said Jain.
