Indore: Lokayukta police have been dragging their feet for last two years on a complaint pertaining to irregularities by a builder who has erected a highrise building in the city in gross violation of norms. When the complaint was filed about the irregularities, the building was under-construction but inaction by the Lokayukta police and other agencies concerned facilitated completion of the structure.
The building in question is Nirvana Luxury Apartment on Manikbagh Main road. Complainant Parmanand Sisodiya, former corporator, has alleged that the contractors were hand in glove with Indore Municipal Corporation officials and altered the building design and carried out additional constructions in violation of norms. Sisodiya had earlier lodged complaints about the building with all authorities concerned.
“Eventually, I approached Lokayukta police. But they also did not act on the complaint. I had levelled charges of corruption and irregularities on the builder and IMC officials,” he said. In his complaint dated 14-7-2016, Sisodiya had claimed that a high-rise structure was coming up in the city in violation of norms. He had alleged that the builder colluded with IMC officials for erecting the high-rise building in defiance with norms and subsequently sought FIR in the matter.
“Firstly, I was told by Lokayukta sleuths to submit an affidavit with the complaint even when I had already submitted it. Still, I gave another affidavit after which my compliant was registered for investigation,” Sisodiya said. Nearly two years have passed since then but the investigation of the Lokayukta police is still not over. Replying to another compliant by Sisodiya, Lokayukta police on December 21, 2017 stated that his previous complaint was already pending. Meanwhile, Sisodiya claimed to have lodged complaints against two more buildings – Vibrant Tower and an apartment in Bijalpur which, according to him, were constructed in deviation of norms.

Lokayukta police sources said that a letter was dashed off to principal secretary (urban development and environment) asking for a report in the matter. “However, he did not respond to the letter. Therefore, the PS has been called after June 20 to clarify into the matter,” a Lokayukta officer said. Lokayukta DG Anil Kumar, however, said he was unaware of the details of the case.

Building map was approved on a residential plot measuring 25,7978 sq ft (Khasra No 1369/1- 1369/20)on March 26, 2013. Total plinth area approved was 30 per cent of the plot size i.e. 7,739 sq ft. Remaining 18,058 sq ft was to be left for MOS, OTS, garden, lift, etc. Initially, permission was for construction of total 36,889 sq ft building with 18 meter height and 1.3 FAR (floor area ratio).
However, the T&CP on July 21, 2014 permitted extending the height of the building to 21 meter and increased the FAR from 1.3 to 1.5. This led to total permitted construction of about 41,000 sq ft. “But the builder allegedly made about 77,000 sq ft construction, which was about 36,000 sq ft more,” complainant Sisodiya claimed.
