DENVER (AP) — Prosecutors say the man accused of killing a security guard last week shouldn't have been released from jail four days before the killing.

The Denver Post reported Wednesday that Caleb Schroeder was released after being sentenced to probation, but prosecutors filed a new charge and thought he'd be held until bond.

Deputies say they had to release Schroeder because a judge hadn't signed a warrant on the new charge.

Denver Performing Arts Complex guard Scott Tice was found stabbed to death May 25. Police used a cellphone that belonged to Tice to help track the man they believe stabbed him with a pocket knife.

Schroeder was arrested later that evening. Court records say police found a bloody pocket knife in his pocket and a security badge pinned to his backpack.
