Govt. to appoint adjudicating officer to hear real estate plaints

Will help to speed up settlement of disputes between home buyers, developers

Aggrieved property buyers can start filing complaints with the Tamil Nadu Real Estate Regulatory Authority (TNRERA) as the State government is all set to appoint an adjudicating officer for disputes between home buyers and developers next week.

The appointment of an adjudicating officer is crucial for delivery of justice for home buyers and property developers. “Any home buyer can approach the adjudicating officer of TNRERA if the developer fails to hand over the project on time,” said an official. Similarly, an aggrieved developer of a property can also file a complaint against a home buyer who has violated the provisions of the Act and rules.

According to sources in the Housing and Urban Development Department, a large number of incomplete construction projects in the city and the suburbs and other parts of the State are likely to be taken over by other developers who will be identified by the government as per the provisions of the Act. “If an aggrieved buyer of a delayed construction project files a complaint, the Authority may also help them get the project completed by identifying another developer who will complete the construction. The buyers may also be permitted to form a society and complete the work,” said an official. As of now, an aggrieved home buyer or a property developer, in case of any dispute, has to approach the appropriate court of law for redressal. In some cases, an arbitrator is appointed by the court to settle the issue, sources said.
