Reps. Doug Collins (R-Ga.) and Vicente Gonzalez (D-Texas) introduced a bill that would direct health plans and PBMs to pass all price concessions, incentive payments and price adjustments onto Medicare beneficiaries at the point of sale. The legislation would also compel PBMs to disclose the fees, price concessions and programs that they use to CMS.
The bill, entitled the Phair Pricing Act of 2018 (H.R. 5958), would also direct the HHS secretary to "establish a working group to determine the quality measures that apply to pharmacy operations," Collins and Gonzalez said.
The Trump administration has proposed to require Medicare Part D plans to return a substantial portion of rebates to beneficiaries at the point of sale. On Thursday, the Congressional Budget Office estimated that the proposal could increase spending by $43.4 billion over a decade if enacted by Congress (see BioCentury Extra, May 24).
