To prevent any defection to the BJP, the Congress is moving their MLAs from the Eagleton resort in Bengaluru. The JDS, which is keeping its MLAs in Shangri La Hotel, is expected to follow suit. While earlier reports stated that the MLAs would be taken to Kochi, Puducherry has emerged as the likelier destination now. The move to shift the MLAs has been in the making since Wednesday, once it became clear that the BJP would get a chance to prove its majority first. Sources say JDS MLAs are being taken to Kochi as well, but HD Kumaraswamy has denied reports. Meanwhile, voices against BJP coming to power in Karnataka despite a fractured mandate have been raised in other states as well. From Mayawati to Akhilesh Yadav and now DMK's working president M K Stalin have slammed B S Yeddyurappa for taking oath as Karnataka chief minister. While Mayawati called it "destruction of Constitution and Akhilesh termed the move as "death of freedom", Stalin said, "All of us saw how PM Modi misused the office of Governor in Tamil Nadu. The same has been done in Karnataka. This is totally against democracy and rule of law. We condemn it."

After several delays and contradictory statements, MLAs who have been lodged in the Eagleton resort in Bengaluru are being moved out in a bus. Their likely destination is Kochi, Kerala, as the Left government in the state had offered them protection. Neighbouring Telangana and Andhra Pradesh have also been mentioned as possible destinations. But giving credence to the reports that the MLAs are headed to Kochi is the heavy police presence outside Kochi’s Crowne Plaza Hotel, where sources say 100 rooms have been booked.

Leader of NPF Legislature Party, TR Zeliang, today commented on the turn of events after the recently held Karnataka Assembly elections. “Should the law of the country be distorted according to the convenience and advantage of a certain political party?” he questioned while wondering how different states were following different rules. He said that while the NPF, with 26 members, was the single largest party in the recently concluded Assembly Election in Nagaland, it was not accorded the same privilege which the BJP, led by BS Yeddyurappa, was given in Karnataka on account of being the single largest Party. “Why the NPF-led Government was not allowed to be formed in Nagaland then?” he quizzed.

When asked if the BJP can elect its own speaker, Siddaramaiah said that cannot happen as there is no assembly as of now. "The governor has given time to prove majority. No executive order can be issued in that position," said the ex-CM.

Amid drama over Karnataka government formation, Vice President M Venkaiah Naidu as people not to worry as democracy is safe. Speaking exclusively to CNN-News18, Naidu said, "Democracy is safe, don't worry." The vice-president's assurance comes soon after allegations were made by both the Congress and the BJP that democracy was under threat, indicating the current political situation in Karnataka. Congress Vice President said earlier in a tweet on Thursday, "The BJP’s irrational insistence that it will form a Govt. in Karnataka, even though it clearly doesn’t have the numbers, is to make a mockery of our Constitution. This morning, while the BJP celebrates its hollow victory, India will mourn the defeat of democracy." Levelling similar allegations, BJP president Amit Shah had claimed democracy was murdered when Congress made an "opportunist offer" to the Janata Dal Secular for the formation of govt in Karnataka.

"It's indeed a dark day for democracy. The highest constitutional functionaries are given this discretion assuming they will conduct fairly. In this case, the governor did not. Centre Misusing ED to Threaten MLAs: HDK | JD(S) leader H D Kumaraswamy today said the Narendra Modi government wants to demolish democracy in the country and accused the Centre of using agencies like the Enforcement Directorate to threaten MLAs of the Congress-JD(S) combine in Karnataka. Addressing reporters after the BJP's B S Yeddyurappa was sworn in as Karnataka chief minister, he also reached out to non-BJP parties to join hands and bury their differences if any to "protect the interest of the country". Terming Governor Vajubhai Vala's decision to invite Yeddyurappa to form the government "unconstitutional", the former chief minister lashed out at the Centre and said, "How is this Central government behaving? This Narendra Modi government wants to demolish democracy in the country." Kumaraswamy, whose claim to form the government was ignored by the governor, added that giving a party without majority the opportunity to form government and giving it 15 days for a floor test was probably a first in the country. "What was the reason for 15 days...is it for business?" he asked. Responding to a question, Kumaraswamy said the Modi government was misusing central government agencies. "They are threatening and putting pressure on MLAs," he alleged. Referring to speculation that Congress MLA Anand Singh, who has been out of touch with his party, could rejoin the BJP, Kumaraswamy said the ED was being used against him as there was a case pending against him. "I have not spoken to Anand Singh... one of the Congress' MLAs told me that Singh had called him and expressed his problem... The Congress MLA gave me the message and asked me to take a lead in this issue," he claimed.

Amid high drama, chief minister B S Yeddyurappa held a cabinet meeting and made promises to announce farm loan waiver of Rs 1 lakh. Yeddyurappa, who had released BJP's manifesto in Bengaluru last month, declared that the decision on loan waiver would be taken in the very first Cabinet meeting if voted to power. Meanwhile, senior Congress leaders, including Ghulam Nabi Azad, Ashok Gehlot and Siddaramaiah, are protested at Vidhan Soudha against the swearing-in. JD(S) leaders joined the protest. Governor Vajubhai Vala administered the oath to Yeddyurappa on Thursday even as none of the council of ministers were sworn in. In a rare pre-dawn hearing, Supreme Court refused to stop BJP leader BS Yeddyurappa's swearing-in as Karnataka Chief Minister. The apex court has posted the matter for hearing on Friday. The court has asked that the letter given by Yeddyurappa and senior BJP leaders to the Governor in which it was stated that the party has the requisite number of MLAs to form the government be produced before the court. During the overnight hearing by the three-judge bench, comprising justices A K Sikri, S A Bobde and Ashok Bhushan, the letter of support from majority of MLAs submitted to the governor for forming the government had become a major sticking point.
The Supreme Court said that it can't overturn the decision of the Governor without seeing on what basis the BJP had claimed to have the numbers. The apex court made it clear that it won't stay the swearing-in but it would be subject to outcome of the petition in the court on Friday. The Congress-JDS had moved the court late on Wednesday night, seeking a stay on the swearing-in, calling it unconstitutional. It argued that the Governor should have invited the majority post-poll coalition of JDS-Congress first. The 15-day window given to BJP to prove its majority was also deliberated upon, but the court refused to modify it, for now.
The three-judge bench, comprising justices A K Sikri, S A Bobde and Ashok Bhushan, said they are wondering whether the Supreme Court can restrain the governor that might lead to constitutional vacuum in the state. The court also observed that the general trend of its past judgments was not to issue injunction or restrain the governor. Over an hour into the hearing, the bench said that unless it sees BJP's letter, it would not know what kind of majority it has. The court observed that it was preposterous to argue, before MLAs take oath, they were not amenable to anti-defection law and it meant it was an open invitation to horse-trading. It also sought to know why the governor gave 15 days for floor test to the BJP and how it was claiming majority when the Cong-JD(S) combine has higher numbers. Attorney General K K Venugopal said the swearing-in was subject to the outcome of floor test and the court can hear the matter after that.
The JDS and Congress had moved the Supreme Court after Governor Vajubhai Vala invited the BJP to form the government first.
Government formation in Karnataka has been a muddled affair with the Karnataka Assembly election results 2018 throwing up a hung Assembly, giving 104 seats to the Bharatiya Janata Party (BJP), 78 seats to the Congress and 37 seats to the JD(S). The Congress has dramatically backed the JD(S) for chief ministership and both parties are likely to parade their MLAs before Governor Vajubhai Vala today morning.
