Chandigarh(Narinder Jagga): Rajya Sabha member and President of Punjab BJP Shwait Malik has allegedly misused the National Emblem for Political activities. A day before, Malik has released a list of Punjab BJP office bearer. But the letter-head, which has been used for it, was printed with lions with Ashoka Chakra in the mid-front. While the Act related to this ‘State Emblem of India (Prohibition of Improper Use) Act, 2005, which says that no person can use the emblem or any imitation in a manner so as to create an impression that it is associated as official document. Act says that violation of this act is punishable upto two years and with fine upto Rs 25,000.BJP State President Malik has released a list of newly appointed office bearer of State BJP on Tuesday. Severn Vice-presidents, three general Secretaries, six secretaries and nine other office bearers has been inducted in new team. But the list, on which it has been released, is on printed letter head of Member of Parliament ( Rajya Sabha) with National emblem, where is the mention about the designation of Malik in BJP. There is also mention of Amritsar as well as Delhi office address.
But section 3 of the State Emblem of India ( Prohibition of improper Use) Act, 2005 describes that No person can use the emblem for commercial purpose or as a part of patent title, trademark or design except in cases as specified by the Central Government. Act also describes that Emblem cannot be used by former functionaries of the Government, Commission or Committee, Public Sector Undertaking, Bank, Municipal Council, Panchayat Raj Institution, Parishad, non-government organisation and University. Sources in the Protocol department also revealed it as violation. Efforts had been made to contact on the mobile to Malik, were gone futile.
