Advocates seek NIA probe against Garhwa SP

Alleging Garhwa SP of targeting advocate Ashish Dubey with some ulterior motives, Advocate Rajiv Kumar, by filing an Interlocutory Application (IA) in the PIL related to the incidents of atrocities on lawyers in the State, wants NIA to investigate the matter.

“The Court has allowed for filing the IA in the matter in which we have demanded also to make National Investigation Agency (NIA) and Ministry of Home Affairs as parties so that independent investigation an could be done in the matter,” said Kumar, the petitioner in person in the matter. Alleging Garhwa SP Md Arshi of being involved in some suspicious activities, he has also attached some photographs and documents, delivering speech in a programme organised organised by Zakat Foundation.

“Members of Zakat Foundation have direct links with Pakistan and openly support the ongoing jehad in Syria,” alleged the advocate. In addition, the Garhwa SP has also close links with the then District Legal Services Authority (DLSA) Officer Md Nayeem Ansari and had helped him going out of way by arresting Chanda Devi, who had made serious allegations against the DLSA officer of making lewd remarks on her, said Kumar.

“Ashish Dubey was targeted because he had been helping Chanda Devi in the case,” said the advocate. All documents and audio CDs, including conversations between Chanda Devi and Md Nayeem Ansari have been enclosed with the IA,” he added.

Dubey, according to Kumar, was also targeted because he had filed a complaint against Chief Minister Raghubar Das for making derogatory comments recently against a particular community.

Meanwhile, dissatisfied with the report submitted by the State Government, the Jharkhand High Court has directed the State to file it again on Wednesday removing the defects in it.

“The court was quite unhappy to see State Government’s report in the matter and pointed out several defects like it did not had doctors’ report who treated Dubey, neither it had statements of the eyewitnesses who were present at the spot,” said Kumar. The Court directed the State Government, fixing the date of hearing on Wednesday, directed it to file the report on Wednesday.

The division bench, taking strong note of the incident, had also directed the Advocate General to submit medical report of the Garhwa advocate, who had been assaulted by the police.

Dubey was allegedly beaten up by the police in Garhwa for taking video of e police personnel  trying to take out the vehicle of Garhwa SP from heavy traffic jam and was later taken into custody but was later released after pressure mounted by the Advocate’s Association.
